1. Acceptance of Terms
By downloading, accessing, or using the Delband mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms at any time, and your continued use of the Service after changes are posted means you accept the updated Terms.
2. Eligibility
You must be at least 18 years old to use Delband. By using the Service, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that all information you provide is accurate and current. We may terminate or suspend any account if we discover the user is under 18 or has provided false information.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to keep your account secure.
4. User Conduct
You agree not to use the Service to harass, abuse, stalk, threaten, defame, or discriminate against any person; to share false, misleading, or fraudulent information; to solicit money, passwords, or personal information from other users; to upload content that is obscene, violent, hateful, or infringing; to impersonate any person or entity; or to interfere with the operation of the Service. We reserve the right to remove content and suspend or terminate accounts that violate these rules without notice or refund.
5. Termination
We may suspend, restrict, or terminate your access to the Service at any time, for any reason or no reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any matches or interactions will be safe or suitable. You use the Service at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, Delband and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or relating to your use of the Service. Our total liability to you for any claim arising from the Service will not exceed the amount you paid us, if any, in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Delband and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Los Angeles County, California.
10. Changes to the Service
We may modify, suspend, or discontinue the Service or any part of it at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
